CarAlert — Penalty and Parking Ticket Notification Platform

Effective Date: 20 December 2025

1. Introduction and Agreement

Welcome to CarAlert. These Terms of Service ("Terms", "Agreement") constitute a legally binding agreement between you ("User", "you", "your") and Park-Support Limited ("CarAlert", "Company", "we", "us", "our"), a company registered in England and Wales under company number 07750032, with its registered office at 160 Kemp House, City Road, London EC1V 2NX, United Kingdom.

By accessing or using the CarAlert mobile application, website, or any related services (collectively, the Service), you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

These Terms apply to all users of the Service, including individual vehicle owners, fleet managers, lease companies, and any other persons or entities accessing or using the Service.

2. Definitions

In these Terms, unless the context otherwise requires:

  • Account means your registered user account on the CarAlert platform, whether Personal or Business.
  • Business Account means an Account registered for commercial, fleet management, or lease company purposes.
  • DVLA means the Driver and Vehicle Licensing Agency of the United Kingdom.
  • Issuing Authority means any local council, parking enforcement authority, private parking company, or other body authorised to issue Penalty Charge Notices or parking tickets.
  • Nominee means an individual designated by an Account holder to receive notifications regarding fines incurred on a specific vehicle.
  • "PCN" or "Penalty Charge Notice" means any penalty charge notice, parking ticket, toll charge, congestion charge, or similar enforcement notice issued in respect of a vehicle.
  • Personal Account means an Account registered for individual, non-commercial use.
  • Platform means the CarAlert mobile application and website through which the Service is provided.
  • VRM means Vehicle Registration Mark, the alphanumeric identifier assigned to a vehicle.
  • Wallet means the digital payment balance maintained within your Account for use in paying fines or other charges through the Service.

3. Eligibility Requirements

3.1 Age Requirement

You must be at least 18 years of age to create an Account and use the Service. By registering for an Account, you represent and warrant that you are at least 18 years old.

3.2 Geographic Availability

The Service is currently available only within the United Kingdom. You may only register vehicles with valid UK Vehicle Registration Marks. While users located outside the UK may be added as Nominees, the core Service functionality is designed for and limited to UK-based vehicle management.

3.3 Account Eligibility

To use the Service, you must:

  • Have the legal capacity to enter into a binding agreement
  • Provide accurate and complete registration information
  • Have lawful authority over any vehicle you register on the Platform
  • Comply with all applicable laws and regulations

4. Account Registration and Responsibilities

4.1 Account Creation

To access the Service, you must create an Account by providing a valid email address, phone number, and password. For Business Accounts, you must additionally provide your business name, business email, phone number, and address. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

4.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your Account credentials
  • All activities that occur under your Account
  • Notifying us immediately of any unauthorised use of your Account
  • Ensuring that your contact information, including email address and phone number, is accurate and up to date

We are not liable for any loss or damage arising from your failure to protect your Account credentials or maintain accurate contact information.

4.3 Account Verification

Account verification is conducted via email or phone number. We reserve the right to request additional verification at any time. We do not verify company registration numbers or business credentials; our verification is limited to confirming valid Vehicle Registration Marks through the DVLA.

4.4 Business Account Responsibilities

If you hold a Business Account, you are responsible for all actions taken through your Account, including those of any authorised users you may add in the future. You must ensure that any person accessing your Business Account complies with these Terms. We may introduce additional features for authorised users in future updates, and such features will be subject to additional terms as notified to you.

5. Service Description

5.1 Core Services

CarAlert provides a platform for managing vehicle compliance and penalty notifications. Our core services include:

  • Vehicle Registration and Management: Register vehicles individually or in bulk via CSV upload using valid VRMs. Vehicle information is retrieved and validated through the DVLA Vehicle Enquiry Service API.
  • Real-Time Notifications: Receive notifications about PCNs, MOT reminders, and vehicle tax status via email, SMS, or push notification according to your preferences.
  • Payment Processing: Pay PCNs and other charges through the Platform using your Wallet balance or payment card.
  • Appeal Submission: Submit appeals against PCNs with supporting evidence directly through the Platform.
  • Nominee Management: Designate individuals to receive notifications about fines incurred on specific vehicles.
  • Vehicle Tagging: Organise and filter vehicles using custom tags.

5.2 Service Limitations

The Service is provided as a notification and management tool only. CarAlert does not issue, enforce, or have authority over PCNs or other penalties. We act as an intermediary to help you receive information and take action, but we are not a substitute for direct communication with Issuing Authorities.

5.3 Third-Party Integrations

The Service integrates with third-party systems including the DVLA Vehicle Enquiry Service API. We plan to integrate with additional Issuing Authorities and parking enforcement bodies. The availability and accuracy of information from these third parties is outside our control, and we disclaim liability for any inaccuracies or delays in information provided by these sources.

6. Nominee System

6.1 Purpose

The Nominee system allows Account holders to designate individuals to receive notifications about fines incurred on specific vehicles. This is particularly useful for lease companies, fleet managers, or vehicle owners who wish to notify drivers of penalties incurred while using their vehicles.

6.2 Nominee Registration and Consent

When you register a Nominee, they will receive an email invitation requiring their explicit consent. A Nominee may accept or decline this invitation. By accepting, the Nominee agrees to receive notifications in accordance with these Terms.

6.3 Nominee Rights and Limitations

Nominees:

  • Receive notifications about PCNs, MOT status, and vehicle tax for assigned vehicles
  • May be designated on a permanent or temporary basis
  • Do not acquire legal liability for fines by virtue of being a Nominee — legal responsibility remains with the registered keeper or driver as determined by law
  • May be removed by the Account holder at any time

6.4 Account Holder Responsibilities

As an Account holder using the Nominee system, you must not add any individual as a Nominee without their knowledge or consent. You must not use the Nominee system to harass, spam, or send unwanted communications to any person. Misuse of the Nominee system may result in immediate suspension or termination of your Account.

7. Acceptable Use Policy

7.1 Permitted Use

You may use the Service only for lawful purposes and in accordance with these Terms. You agree to use the Service solely for managing vehicles over which you have lawful ownership, custody, or control.

7.2 Prohibited Conduct

You agree not to:

  • Register any vehicle for which you do not have lawful ownership, custody, or authority
  • Submit fraudulent, false, or misleading appeals or evidence
  • Submit appeals in bad faith or for the purpose of evading legitimate penalties
  • Create multiple Accounts to circumvent restrictions or abuse Service features
  • Use automated systems, bots, scrapers, or similar technology to access the Service without our express written permission
  • Attempt to gain unauthorised access to any part of the Service, other Accounts, or our systems
  • Resell, sublicence, or commercially exploit the Service without our express written consent
  • Add Nominees without their consent or use the Nominee system to harass individuals
  • Interfere with or disrupt the Service or servers or networks connected to the Service
  • Violate any applicable law, regulation, or these Terms

7.3 Vehicle Registration Confirmation

When registering a vehicle, you must confirm that you are the registered keeper, have lawful authority over the vehicle, or have been authorised by the registered keeper to manage the vehicle through the Service. We rely on this confirmation and do not independently verify vehicle ownership beyond validating the VRM through the DVLA.

8. User-Generated Content and Appeals

8.1 Appeal Submissions

The Service allows you to submit appeals against PCNs, including uploading supporting evidence. When submitting an appeal, you are responsible for ensuring that all information provided is accurate, truthful, and complete.

8.2 Evidence Upload

You may upload evidence files in the following formats:

  • Images: PNG, JPG, JPEG
  • Documents: PDF, DOCX, DOC

The maximum file size for uploads is 10MB per file.

8.3 Content Processing

Appeals and evidence are transmitted automatically to the relevant Issuing Authority without review by CarAlert. We do not moderate, edit, or assess the content of your appeals before submission. Once submitted, neither you nor CarAlert administrators can view or retrieve the uploaded evidence files. Evidence is retained only for the purpose of transmission to the Issuing Authority and for as long as required by the Authority, or until you delete your Account.

8.4 Content Responsibility

You bear sole responsibility for the accuracy, legality, and appropriateness of any content you submit through the Service. If your appeal is rejected due to insufficient or improper evidence, you accept that this may result in escalation of your fine or loss of appeal rights, and CarAlert bears no liability for such outcomes.

8.5 Licence Grant

We do not claim ownership of any content you upload. You grant us only a limited, non-exclusive licence to store and transmit your content solely for the purpose of providing the Service, including forwarding appeals and evidence to the relevant Issuing Authority.

9. Intellectual Property

9.1 Our Intellectual Property

The Service, including all content, features, functionality, software, text, graphics, logos, and trademarks (including "CarAlert"), is owned by Park-Support Limited or its licensors and is protected by United Kingdom and international intellectual property laws.

9.2 Licence to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal or internal business purposes. This licence does not include the right to sublicence, resell, or distribute any part of the Service.

9.3 Restrictions

You may not:

  • Copy, modify, adapt, or create derivative works of any part of the Service
  • Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the Service
  • Remove, alter, or obscure any copyright, trademark, or other proprietary notices
  • Use CarAlert branding, logos, or trademarks without our express written permission
  • Frame or mirror any part of the Service without our prior written consent

10. Payments and Wallet

10.1 Payment Processing

All payment transactions are processed through Stripe, our third-party payment processor. By making a payment through the Service, you agree to Stripe's terms of service. All payments are made in British Pounds Sterling (GBP).

10.2 Wallet System

Your Account includes a Wallet feature that allows you to:

  • Add funds via credit or debit card through Stripe
  • Use Wallet funds to pay PCNs and other charges
  • View your current Wallet balance

Wallet balances do not expire and remain available until used or your Account is deleted.

10.3 Wallet Withdrawals

Withdrawals from your Wallet are not available through the Platform directly. If you wish to request a withdrawal of unused Wallet funds, you must contact our support team at support@caralert247.com. Withdrawal requests are processed at our discretion and may be subject to verification requirements.

10.4 PCN Payments

When PCN payment functionality is available, CarAlert acts as a payment facilitator, enabling you to pay fines to Issuing Authorities through our Platform. We do not currently charge a service fee for PCN payments, but we reserve the right to introduce fees in the future with prior notice.

10.5 Payment Responsibility

You are responsible for ensuring timely payment of all PCNs and charges. We strongly advise processing payments immediately upon notification to avoid escalation. While we endeavour to resolve payment processing issues within one to three hours, any delays caused by your inaction, failure to maintain sufficient funds, or decisions to delay payment until the deadline are your sole responsibility.

11. Refunds

11.1 Refund Eligibility

Refunds may be issued only in the following circumstances:

  • Technical Errors: Where a payment failure or technical error on our part has caused you loss
  • Duplicate Payments: Where you can provide evidence that the same PCN was paid twice through our Platform

11.2 Non-Refundable Items

The following are non-refundable: Wallet balances upon Account termination; PCN payments where the fine was validly issued; payments made after the deadline where you chose to delay action; and any situation where loss results from your failure to act on notifications or maintain accurate contact information.

11.3 Refund Process

To request a refund, contact support@caralert247.com with details of the transaction and reason for the refund request. Refund requests are assessed on a case-by-case basis and we will respond within 24 to 48 hours.

12. Termination

12.1 Termination by You

You may terminate your Account at any time by contacting our support team at support@caralert247.com. Upon receiving your termination request, we will initiate the account closure process.

12.2 Termination by CarAlert

We may suspend or terminate your Account:

  • For breach of these Terms
  • For fraudulent or illegal activity
  • Immediately and without prior notice for serious violations, with after-the-fact notification provided

12.3 Effect of Termination

Upon termination:

  • You have 30 days to appeal the termination decision
  • Wallet balances are non-refundable
  • Your data will be deleted in accordance with our Privacy Policy after the 30-day appeal period
  • Any outstanding obligations survive termination

12.4 Surviving Provisions

The following provisions survive termination: Sections 9 (Intellectual Property), 13 (Disclaimers), 14 (Limitation of Liability), 15 (Indemnification), 16 (Governing Law), and 17 (Dispute Resolution).

13. Disclaimers

13.1 Service Provided "As Is"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

13.2 Third-Party Data Disclaimer

We disclaim responsibility for the accuracy, completeness, or timeliness of:

  • DVLA Data: Vehicle information is obtained directly from the DVLA Vehicle Enquiry Service API. We relay this information as received and are not responsible for any inaccuracies in DVLA-sourced data.
  • PCN Data: Information regarding PCNs and penalties is provided by Issuing Authorities. We relay this information as received and are not responsible for errors, omissions, or delays from these sources.

13.3 Notification Disclaimer

While we make multiple attempts to notify you of relevant events via your chosen notification channels (email, SMS, push notification), we cannot guarantee delivery of notifications. The Service does not remove your independent responsibility to monitor your vehicles and respond to penalties. You must ensure your contact details are accurate and up to date. We are not liable for missed notifications resulting from incorrect contact information, spam filters, mobile network issues, or other delivery failures outside our control.

13.4 Appeal Outcome Disclaimer

We provide tools to submit appeals but do not guarantee any particular outcome. The decision to accept or reject an appeal rests solely with the relevant Issuing Authority. We are not liable for rejected appeals, escalated fines, or any other consequences arising from your appeal submissions.

13.5 No Legal or Financial Advice

The Service is a management and notification tool only. Nothing in the Service constitutes legal, financial, or professional advice. For advice regarding specific penalties, appeals, or legal matters, you should consult a qualified professional.

14. Limitation of Liability

14.1 Exclusion of Certain Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CARALERT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to, use of, or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorised access, use, or alteration of your transmissions or content
  • Missed deadlines, escalated fines, or failed appeals
  • Inaccuracies in third-party data including DVLA or Issuing Authority information

14.2 Liability Cap

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL FEES YOU PAID TO CARALERT IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED POUNDS STERLING (£100).

14.3 Statutory Rights

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.

15. Indemnification

You agree to indemnify, defend, and hold harmless Park-Support Limited, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from:

  • Your use of the Service
  • Your breach of these Terms
  • Any false, misleading, or inaccurate information you provide
  • Fraudulent appeals or evidence you submit
  • Registration of vehicles for which you lack authority
  • Misuse of the Nominee system
  • Your violation of any applicable law or regulation

16. Governing Law

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or their subject matter or formation (including non-contractual disputes or claims).

17. Dispute Resolution

17.1 Complaints Procedure

If you have a complaint about the Service, please contact us at support@caralert247.com. We aim to acknowledge complaints within 24 hours and provide a resolution within 24 to 48 hours. Complex matters may require additional time, and we will keep you informed of progress.

17.2 Informal Resolution

Before commencing any formal legal proceedings, you agree to attempt to resolve any dispute informally by contacting us. We will endeavour to resolve the dispute through good-faith negotiation.

17.3 Small Claims Court

Nothing in these Terms limits your right, or ours, to bring a claim in the small claims court for disputes within its jurisdiction.

17.4 Class Action Waiver

TO THE EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

If this provision is found to be unenforceable, then the entirety of this arbitration section shall be null and void.

17.5 Enforcement Proceedings

CarAlert is not a party to any legal proceedings between you and an Issuing Authority regarding PCNs or penalties. We provide notification and payment facilitation services only and do not represent you in any enforcement or court proceedings.

18. Modifications to Terms and Service

18.1 Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will notify you via email and in-app notification. The updated Terms will include a new "Effective Date" at the top of the document.

18.2 Acceptance of Changes

Your continued use of the Service after the updated Terms take effect constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service and may terminate your Account in accordance with Section 12.

18.3 Changes to Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. For significant changes that affect core functionality, we will provide notice ranging from one week to one month in advance, depending on the extent of the changes. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

19. General Provisions

19.1 Entire Agreement

These Terms, together with our Privacy Policy (available at https://landing.caralert247.com/privacy), constitute the entire agreement between you and CarAlert regarding the Service and supersede all prior agreements and understandings.

19.2 Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.

19.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorised representative of CarAlert.

19.4 Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

19.5 No Third-Party Beneficiaries

These Terms do not confer any rights on any third party under the Contracts (Rights of Third Parties) Act 1999 or otherwise.

19.6 Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, government actions, power failures, internet or telecommunications failures, or actions of third-party service providers.
